Ad-disclosure rules every influencer agency should have written down

Paid partnership disclosure isn’t optional style guidance — it’s a legal requirement with real enforcement, and the rules differ enough between the EU and elsewhere to be worth writing down.

"#ad" in a caption is the visible part of a rule that goes considerably deeper. In Germany, undisclosed paid promotion can trigger a formal Abmahnung (cease-and-desist) even when the creator genuinely likes the product — intent doesn't matter, disclosure does. The EU-wide baseline sits in the Unfair Commercial Practices Directive, layered under each member state's own implementation.

The part agencies most often skip in writing is who's responsible when a post is late on disclosure or platform-mislabeled: the brand, the agency or the creator. Putting that answer in the contract before a campaign starts — not after a complaint arrives — is the difference between a quick fix and a genuine liability question.
